Welcome to Easter Egg and Ultimate Fantasy Battle (“UFB”). These Terms of Service (“Terms”) are an agreement between you and Thig.io, LLC (“Thig.io”, “we”, “us” or “our”), which owns and runs UFB. They cover:
- the website at easteregg.fun, including its pages, the in-browser game at easteregg.fun/play and its game servers (the “Site”);
- any UFB app we release;
- player accounts, heroes, gold, levels, skill trees and everything else you do in the game (with the Site, the “Services”);
- physical UFB products we sell, such as figurines, game boards and maps (the “Products”).
Our Privacy Policy explains what information we collect and how we use it. It is part of these Terms.
Please read section 17 carefully. Unless you opt out, or local law says otherwise, you and Thig.io agree to settle disputes by individual binding arbitration. That means no class actions and no jury trials.
1. Agreeing to these Terms
Using the Services or buying a Product means you accept these Terms. If you don't accept them, please don't use the Services.
You must be at least 18, or the age of majority where you live, to accept these Terms yourself. If you are younger, a parent or legal guardian must agree to them for you, and they are responsible for what you do on the Services.
You must be at least 13 to create an account. Younger children may play as a guest while a parent or guardian supervises. Guest play doesn't ask for any personal information.
If you are a parent or guardian and believe your child is using the Services without your consent, email support@thig.io and we will help.
Some features or Products may come with extra terms (“Supplemental Terms”), such as the rules of a contest. We'll show them to you when they apply. If Supplemental Terms conflict with these Terms, the Supplemental Terms win for that feature.
2. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page. If a change is significant and you have an account, we will also tell you on the Site or by email before the change takes effect.
If you keep using the Services after the change takes effect, you accept the new Terms. If you don't accept them, stop using the Services. You can also ask us to delete your account.
3. Accounts and guest play
You can play UFB as a guest without an account. Guests keep no gold, can't level heroes, and their progress is tied to one browser.
An account lets you keep gold, level heroes, build skill trees and claim figurines. When you sign up:
- give a real email address you control and keep it up to date;
- choose a strong password that you don't use anywhere else;
- don't share your account or sign in to anyone else's;
- tell us straight away if you think someone else has got into your account.
You are responsible for everything done through your account.
Display names must not be hateful, sexual, abusive, or impersonate someone else. They must not use a trademark you have no right to. We may change or reclaim a display name that breaks this rule.
You can close your account at any time by emailing support@thig.io from the address on it. We can suspend or close an account that breaks these Terms (see section 15).
4. Gold, levels and other game items
The game has virtual items: gold, hero levels, skill-tree nodes, items and loot won in play, and anything similar we add later (“Game Items”).
Game Items are part of the game, not property. You don't own them. We grant you a limited, revocable licence to use them in the game.
Game Items have no cash value. They can't be sold, traded for money, cashed out or refunded, and they can't be moved to another account except through features we provide for that. The only exception is releasing a figurine, described in section 5.
We keep working on game balance. So we may change how gold is earned or spent, what levels and skills do, and how heroes, items and maps work. In rare cases, such as a bug, cheating, or restoring from a backup, we may correct or reset balances and progress.
We don't currently sell gold or other Game Items for real money. If we ever do, we'll tell you the price before you pay.
5. Figurines, claim codes and heroes
UFB heroes are unlocked with physical figurines. Each figurine has an NFC chip and comes with a claim code. Tapping the chip or entering the code claims the figurine's hero for your account.
- One account at a time. A figurine can be claimed by only one account at a time. If a figurine is already claimed, it can't be claimed again until the account holding it releases it.
- Progress stays with the figurine. The hero's level, elements and skill tree belong to the figurine, not to the account. If you release a figurine and someone else claims it, for example after you sell or give it away, its progress goes with it. You lose access to that hero when you release it.
- Keep your code safe. Anyone with the claim code or the chip can claim an unclaimed figurine. Treat the code like a password until you have claimed it. We can't replace heroes claimed by someone else with a code you shared or lost. Contact us if you think a code was misused, and we'll look into it.
- Misuse. We may cancel claims made with codes that were guessed, stolen, copied or obtained by fraud. We may also cancel claims for figurines that were refunded or charged back, and for chips that were cloned or tampered with.
- What you are buying. A figurine is a physical Product, and it grants you the right to use its hero in the game while you hold the claim. It doesn't give you ownership of the hero's characters, art or other intellectual property.
If we ever stop running the online game, the figurines remain yours as physical Products for tabletop play.
6. Buying Products
This section (the “Terms of Sale”) applies when you buy a Product from us, whether through the Site or a store we run. If you buy from another retailer, that retailer's terms apply to the sale instead.
Who can buy. You need a valid billing and shipping address. Products are for personal, family or household use. We may limit how many of a Product one person or household can buy, and we may refuse or cancel an order. If we cancel an order, we refund anything you paid for it.
Prices and taxes. Prices don't include taxes or shipping unless we say they do. Both are shown at checkout before you pay. Prices may change, but a price change never affects an order we have already accepted.
Payment. Payments are handled by a third-party payment processor, and we never see or store your full card number. You confirm that you are allowed to use the payment method you give us.
Order acceptance. We accept your order when we send you a confirmation. We must receive payment before then.
Shipping. We ship to the address you give us. Delivery dates are estimates. Risk of loss passes to you when the carrier delivers the Product, unless the law where you live says otherwise.
Errors. If a price, description or stock level on the Site is wrong, we may correct it. If the correction affects your order, we'll contact you before charging you. You can then cancel for a full refund.
Appearance. Colours on screen may look different from the real Product. Sizes and weights are approximate.
7. Returns and refunds
You can return a Product bought from us within 30 days of delivery, if it is unused and in its original packaging. If a figurine has been claimed, release it from your account before returning it.
To start a return, email support@thig.io with your order number. We'll tell you where to send the Product. Once we receive it, we refund the purchase price to your original payment method.
Unless the Product was faulty or we made a mistake, we don't refund the original shipping cost or the cost of sending it back.
We can't accept returns of Products bought from other retailers, items marked “final sale”, or bulk orders of 6 or more of the same Product. Faulty or damaged Products are always covered.
When a figurine is refunded, the claim made with it ends.
This policy adds to any rights you have under consumer law and never takes them away. For example, consumers in the EU and UK can cancel a distance purchase within 14 days of delivery without giving a reason.
8. Choking hazard
Warning: figurines and game pieces are small parts and may be a choking hazard. They are not for children under 3. Supervise children when they play with UFB Products, and never put pieces in your mouth.
9. Our content and your licence
The Services and Products belong to Thig.io or our licensors. This includes the game, the rules, the story, the manga, the art, the 3D models, the maps, the music, the software, and the Thig.io, Easter Egg and UFB names and logos. Copyright, trademark and other laws protect them.
If you follow these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial play. You may print or save a single copy of the rulebook to play UFB. You may share screenshots and videos of your games, as long as you don't suggest that we endorse you.
Everything else requires our written permission. This includes copying, selling, redistributing or modifying our content, or building derivative works from it.
10. Rules of conduct
When using the Services, you agree not to:
- break any law, or anyone else's rights;
- harass, threaten or abuse other players;
- cheat. This includes running bots or scripts, exploiting bugs, altering the game client or the messages it sends, or tampering with game results or gold;
- guess, brute-force, copy or trade claim codes, or clone NFC chips;
- use someone else's account, or impersonate any person or organisation;
- try to get into systems or data you don't have access to, or disrupt, overload or attack the Services;
- scrape the Services, except that search engines may index public pages in line with our robots.txt;
- reverse engineer the Services, except where the law allows it despite this rule;
- resell access to the Services, or use them for spam or advertising.
If you find a bug or security problem, please report it to support@thig.io rather than using it. We appreciate reports made in good faith.
11. Feedback and content you send us
You might send us ideas, bug reports, suggestions or other feedback. If you do, we may use it freely, without paying you or owing you anything.
If you send us other content, such as a message through a contact form, you confirm that you have the right to send it. You also give us permission to use it to answer you and to run the Services.
12. Translations
We offer the Site and the game in several languages. Some translations are made with the help of machine translation and may contain mistakes. The English version of these Terms and the Privacy Policy is the one that applies. If a translation disagrees with it, the English version governs, unless the law where you live requires otherwise.
13. Third-party services and links
The Services use outside providers. For example, fonts come from Google Fonts, the newsletter runs on Mailchimp, and payments go through a payment processor. The Site also links to outside sites such as our social media pages.
We aren't responsible for third-party services or sites. Their own terms and privacy policies apply when you use them.
14. The game is a work in progress
UFB is actively developed. We may add, change or remove features, heroes, maps and rules at any time. We may also restart the game servers for updates, which can end matches in progress.
We try to keep the Services available, but we don't promise that they will always be online or error-free.
If we plan to shut down the online game for good, we will give account holders at least 30 days' notice on the Site.
15. Suspension and termination
We may suspend or close your account, or remove Game Items, if you break these Terms, if we must do so by law, or to protect other players or the Services. We may do this without notice where there is fraud, cheating or a security risk. Otherwise, we will tell you why.
If you think we made a mistake, email support@thig.io.
A figurine you own remains yours as a physical Product, even if we close your account.
16. Disclaimers and limits of liability
The Services are provided “as is” and “as available”. As far as the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Services are uninterrupted, error-free or free of harmful components.
As far as the law allows, Thig.io and its officers, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data.
Our total liability for any claim about the Services or Products is limited to the greater of US$100 or the amount you paid us in the 12 months before the claim.
These limits don't apply to fraud, gross negligence or wilful misconduct, or to anything the law says can't be limited. This includes liability for death or personal injury caused by negligence, and your statutory rights as a consumer.
You agree to indemnify and defend Thig.io against third-party claims caused by your breach of these Terms or your misuse of the Services. You will cover costs arising from those claims.
17. Disputes and binding arbitration
Talk to us first. Before filing a claim, email support@thig.io with:
- your name, address and email;
- a description of the dispute;
- what you want.
We'll try to settle it within 30 days. If we have a claim against you, we'll contact you the same way at your account email. Deadlines are paused during those 30 days.
Arbitration. If we can't settle a dispute informally, it will be decided by binding arbitration before one arbitrator. The arbitration is run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this section.
- Hearings are held by video or phone unless the arbitrator decides otherwise.
- Claims of US$25,000 or less are decided on written submissions.
- For arbitration you start, you pay the consumer filing fee and we pay the rest of the AAA's fees. For arbitration we start, we pay all the fees.
There are two exceptions. Either of us may bring a claim in small-claims court. Either of us may also go to court over the misuse of intellectual property.
No class actions. Disputes are resolved individually, not as a class, collective or representative action, and both of us give up the right to a jury trial.
If 25 or more similar claims are filed by the same or coordinated lawyers, the AAA's Supplementary Rules for Multiple Case Filings apply. The cases then go ahead in batches (a “bellwether” process).
Opt out. You can opt out of arbitration within 30 days of first accepting these Terms. Email support@thig.io with your name, address, account email and a clear statement that you are opting out. If you opt out, disputes go to the courts named in section 18.
If we change this section, you may reject the change within 30 days by emailing us. The previous version then continues to apply to you.
If any part of this section is found unenforceable, that part is removed and the rest still applies. A claim for public injunctive relief can go to court, where the law allows.
This section doesn't apply where the law you live under forbids it. For example, it doesn't take away a consumer's right to sue in their home courts in the EU or UK.
18. Governing law
These Terms are governed by the laws of the State of Washington, USA, and applicable US federal law, without regard to conflict-of-law rules.
Any dispute that isn't arbitrated will be heard in the state and federal courts of King County, Washington, and you and we both agree to their jurisdiction.
If you are a consumer, you also keep the protection of any mandatory laws of the country where you live.
19. Export controls
You may not use the Services or buy Products if you are in a country under a US embargo, or if you are on a US government list of restricted parties.
20. General
These Terms, together with the Privacy Policy and any Supplemental Terms, are the whole agreement between you and us about the Services.
If one part is found unenforceable, the rest still applies. If we don't enforce a right, that doesn't mean we have waived it.
You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets. We may communicate with you electronically.
California consumers: under Civil Code §1789.3, you can contact the Complaint Assistance Unit of the California Department of Consumer Affairs. Write to 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or call (800) 952-5210.
21. App stores
If you get a UFB app from an app store, such as Apple's App Store, these Terms are between you and Thig.io, not the store. The store has no obligation to support the app.
If the app doesn't meet a warranty, the store's only duty is to refund what you paid it for the app. Thig.io, not the store, handles any claims about the app. The store and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
